FORENIC EVIDENCE 'A BLUFF'

Forensic evidence against Kate and Gerry McCann is inconclusive and is being overplayed by Portuguese detectives.

Blood spots found in their rented car were microscopic and the quality so poor that experts could not even say whether they came from a boy or a girl.

The revelations add to concern that Portuguese police are trying to "bluff" a confession from the McCanns, who strenuously deny killing their daughter Madeleine.

Bricks suspected of being used to bludgeon the four-year-old girl to death were also examined by scientists in Birmingham but no blood was found on them or any other useful forensic information.

A child's left boot was also examined but it did not produce conclusive information, though experts thought there could be some bodily fluids on it.

Senior detectives in the Algarve are preparing to press charges against the McCanns, both 39, as early as tomorrow and will attempt to keep the couple behind bars until the trial.

They have both been named as official suspects in the case. Now Kate McCann has told her mother she believes Portuguese police are corrupt.

Susan Healey, of Mossley Hill, Liverpool, said she spoke to her daughter on the phone after she had been questioned for a total of 16 hours over two days and thought she sounded "very upset".

Susan, 62, said: "Kate is very afraid. She is worried about her other children and concerned about having to go before a judge. "She knows they are questioning her story, and she fears they won't let her come home.

"The last thing she said to me was: 'Mum, they are corrupt'." Lawyers have warned Kate that her two-year-old twins Sean and Amelie may be taken away from her if she is charged. If found guilty of manslaughter, she faces around 10 years in prison.

Experts at the forensic laboratory in Birmingham were sent a variety of items to examine microscopically by Portuguese police.

It has been widely reported that blood found in the back of the Renault Scenic rented by the McCanns 25 days after their daughter vanished on May 3 matched Madeleine's.

But British police sources suggest the report from the forensic lab was not conclusive and the information has been greatly overplayed.

A source said: "Quite frankly the forensic evidence would not make the grade for a prosecution in this country. They could not say for certain that the blood from the car was from a boy or a girl, never mind matching it to Madeleine's blood.

"There was one spot on a door panel and some elements on the frame of the boot, but they could not be seen with the naked eye. They used a chemical called Luminol to enhance the samples but even that was very difficult.

"They were also looking for chemicals showing that someone had tried to wipe away blood – to clean up but they didn't find any.

"You expect to see some cleaning chemicals appearing if someone has tried to clear up a lot of blood. There are smears and residue. They looked for evidence that the sample contained a sedative or poison, but again nothing came up.

"They were also asked to try to ascertain if the blood could have come from a living person, that Madeleine could have been put in the boot when alive and that blood had come from exhaled air through the nose or mouth, but there was nothing to suggest that.

"They were looking for a spray of microscopic blood spots but there weren't any, which would have been consistent with exhaled air.

"The experts have made the point that it is very unlikely that there would have been any blood specks from a body which had been dead for some weeks. A fleece and a used milk carton were also tested but they did not produce anything worthwhile."

The District Attorney in Portimao is reportedly finalising a case against them which will see Kate charged with manslaughter and hiding a body and Gerry prosecuted as an accessory.

Under the conditions of their "suspect" status they have not yet been prevented from leaving Portugal. On the forms signed by the McCanns relating to their suspect status, the couple gave their address as Rothley, Leics, signalling an imminent return to the UK, possibly as early as tomorrow.

The spokesman said: "Gerry strongly desires to come home with his family but as always he's keen to co-operate with the investigation." Madeleine disappeared from the Algarve resort's Ocean Club complex while her parents were dining at a tapas bar 50 yards away.

It has been reported that during hours of gruelling interrogation in the judicial police station in Portimao the couple refused to answer more than 40 questions. The vital questions are believed to relate to the blood samples found in the Renault Scenic.

Kate allegedly claimed that the scent of death found on her clothing related to a corpse she handled in her work as a GP days before they arrived in Praia da Luz on holiday at the end of April.

Consultant cardiologist Gerry was formally named as a suspect in the early hours of yesterday morning after leaving the police station looking exhausted and shaken following 12 hours of questioning.

He was accompanied by David Hughes, who is employed by the Find Madeleine Campaign, and a member of the British consulate staff.

The couple have been in close contact with the Foreign Office, who have offered them full support. Scotland Yard detectives are concerned about the quality of forensic evidence and what weight to attach to it.

A Portuguese-speaking Yard detective has been working closely with police in Portugal and feeding information back to senior officers in London.

A source said: "The Yard believes if this had been handled properly from the outset there would have been a lot more forensic evidence to work with.

"The room where Madeleine was taken should not have been rented out and there should have been a lock down at the complex until police had checked guests. The crime scene was trampled all over."

Kate's uncle yesterday insisted: "She has nothing to fear. She has nothing to hide."

Brian Kennedy said: "The notion that Kate did away with the daughter she is absolutely devoted to is pure nonsense."

In an impassioned defence of his niece, he said: "The suggestion that Kate killed Madeleine, hid her body and 25 days later put her in a car and moved her under the glare of international publicity and with family and friends around is just fatuous beyond words. This notion is repulsive."

Retired head teacher Brian, 69, told how Kate was "holding up well" under the circumstances. "She's not upset, she's just very angry," he said. "It's a good emotion for her to feel. She's not an emotional person, she's extremely steady.

"Her training and career as a doctor has made her like that. Gerry is the same, a very rounded, strong character."

Brian, who lives in the couple's home village of Rothley, spoke to his niece yesterday. He said: "She's very tired but otherwise holding up well. We spoke about the twins, not really about the police investigation.

"If a deal was offered to Kate to confess, the most unlikely person to accept it is Kate. There is no reason to accept a deal that makes her guilty."

He urged the public not to turn against his niece. "Mud sticks. But people who know Kate and Gerry will not let mud stick. Kate's been booed but she's also had quite a lot of cheering. "I have known Kate since she was born and I support her whole-heartedly.

"I believe Madeleine is still alive. There is no evidence to suggest she is dead."

KATE and Gerry McCann may have to apply to the European Court of Human Rights to clear their names, legal sources said last night.

The couple believe they are likely to remain official suspects for many years, making it difficult for them to begin rebuilding their lives.

Despite a lack of progress in the police investigation and ­little solid evidence, it is believed that the Portuguese authorities will not lift the McCanns' "arguido" status in the coming months.

It raises the prospect of a protracted legal battle through the Portuguese courts, which could eventually end in the human rights court.

Lawyers representing Kate and Gerry, who were declared suspects in September – four months after Madeleine dis┬¡appeared – will attempt to clear their names officially in the New Year.
­
But should that fail, they are prepared for a lengthy and bitter legal battle.

The couple had hoped they would be officially cleared next month – eight months after Madeleine vanished and the normal legal limit for a police investigation in Portugal.

But because of the high profile of the case the authorities have granted it exceptional status, meaning the deadline will not apply.

"They could be arguidos for ever," a source close to the McCanns said yesterday. "It could take years to have the status lifted."

The only other official suspect, British expat Robert Murat, also remains an arguido in the case.

PRESSURE MOUNTS ON SOCIAL WORKERS TO REMOVE TWINS

Social workers held talks with police and lawyers yesterday over the future care of twins Sean and Amelie McCann.

On their first full day back at home, parents Gerry and Kate faced a growing groundswell of public opinion for social workers to remove the two-year-olds.

By yesterday nearly 17,000 people had signed an internet petition calling for social services to fulfil their "statutory obligation" and investigate Madeleine's disappearance.

The petition noted that she and the twins had been left in an "unlocked ground-floor hotel room".

With public opinion turning, Leicestershire Social Services had a series of meetings and must now weigh the couple's apparently blameless previous lifestyle against the fact that they are now suspects in their daughter's disappearance in Portugal.

They may want to ask Gerry and Kate why they left all three children alone in the holiday apartment.

As their future was being discussed, the McCanns were the subject of a BBC Radio Five Live phone-in on the subject of support for them. But it was abandoned when it became clear a number of callers were hostile to the couple.

The McCanns risk raising further wrath by using money donated to help find Madeleine to fund expensive celebrity lawyers.

Yesterday's developments were the latest in a string of blows to the couple who fled Portugal at the weekend after being named as official suspects in their daughter's disappearance.

The couple saw dawn break over their family home in Rothley, Leicestershire, for the first time since they left it more than four months ago.

They were then a professional family with three children and the world at their feet. Yesterday they fought to re-establish something approaching a normal routine for the twins, knowing their domestic life may never be the same again.

Gerry McCann's sister Philomena denied in a radio interview yesterday any suggestion that the couple, both medically trained, ever sedated their children.

She said the strongest medicine they would ever have used was Calpol, and the strongest rebuke ever meted out to Madeleine was to make her sit on the "naughty step".

She also told BBC Breakfast: "The way the Portuguese have turned this investigation round, and are no longer looking for a live child, they are assuming on spurious evidence that Madeleine is now dead. Well, we don't agree with that. We want the investigation changed round to look for Madeleine alive."

At least in the village of Rothley, locals appeared to wholly support the couple, despite the recent dramatic turn of events in Portugal.

Mr Percy Hartshorn, chairman of Rothley Parish Council, said: "As a village we are very much behind the McCanns. They are back home now in familiar surroundings and we will do everything we can to give them all the support they need."

And the vicar of Rothley, the Rev Rob Gladstone, said: "We're very supportive of Gerry and Kate and feel after today that their privacy should be respected. We hope here in Rothley we can provide them the space for that to happen."

More flowers and cards appeared around the war memorial in the centre of the village, cleared of the first wave of such tributes some weeks ago.

Yesterday one visitor to the house delivered several bouquets of flowers and another, a more practical consignment of food. Gerry and Kate, both 39, issued statements via Madeleine's great uncle, retired headmaster Mr Brian Kennedy, and family spokeswoman Justine McGuinness.

They made it clear that they had no plans to leave their house yesterday, and, mainly because of the unfolding legal situation in Portugal, had nothing to say.

Mr Kennedy said: "They are bearing up very well. They have had a decent night's sleep. They're managing very well. They are holding up extremely well. We believe that Madeleine is still alive and we want to concentrate on looking for Madeleine."

He dismissed the move by Portuguese police to treat the McCanns as suspects as "that recent business".

Fighting the accusations could cost hundreds of thousands of pounds and the McCanns have revealed that they want to use the Find Madeleine campaign to cover costs.

It was set up after her disappearance and thanks to the generosity of millions of ordinary people touched by their plight the fund quickly topped the £1million mark, earning thousands each month in interest.

But public relations experts have warned that sympathy for the family will be swiftly destroyed if they use the money for anything other than looking for Madeleine.

There were further clues yesterday of the enormous pressures faced by the McCanns when a crime prevention expert spent more than an hour at their home to brief the couple on security measures.

TWINS QUIT CRECHE AFTER KATE IS CAUGHT IN CRUSH

MADELEINE McCann's parents suffered further anguish yesterday when they were compelled to stop taking their twins to the resort creche because other parents were "getting upset".

Matters came to a head on Tuesday when Kate could not get out of the Mark Warner Ocean Club creche with her two-year-old twins, Sean and Amelie, because of a media scrum.

She said yesterday: "We are trapped. What can we do?"

Kate and her husband are clearly hurt that their children cannot go to the creche any more, but Gerry tries to be pragmatic.

He said: "It has impacted on other holidaymakers. It is not considerate to other people's children and people were getting upset.

"They have paid a lot of money to come to a lovely resort with their children. Mark Warner has been incredibly supportive of us throughout, but they have come under a bit of pressure and we agreed not to go for a while.

"They offered us alternative arrangements, but we haven't taken them up yet."

With a "huge gaggle" of Portuguese media outside the McCanns' new accommodation, the move followed concerns about photographers and film crews taking pictures of the twins and disturbing holidaymakers using the child-minding facility.

The Ocean Club issued a statement pleading for journalists to leave the couple alone.

It read: "(The McCanns) do not want to cause undue disruption to holidaymakers, or to locals living in the village, as a result of filming and photography by the media. They have therefore decided not to use the creche facilities at the Ocean Club while there is such a significant media presence.

"This means that they will not be coming to the Club with their children for the foreseeable future and would like to ask the media to respect their privacy and that of those on holiday in the village."

The McCanns have been trying to maintain a normal routine for their twins, taking them to the creche each day.

A spokesman for Mark Warner said: "Kate and Gerry are worried that this may be affecting other families on holiday."

In a plea to the media he added: "On behalf of Mark Warner and the Ocean Club, please help us to allow all our guests to enjoy their time here in the Algarve."

MADELEINE 'ABDUCTOR' IMAGE RELEASED

The parents of Madeleine McCann have released artist's impressions of the man they believe abducted their daughter.

It is understood the images - which depict a man of southern European or Mediterranean appearance walking with a child in his arms - were drawn by an FBI-trained forensic artist from the eyewitness account of Jane Tanner, one of the group of friends who dined with Gerry and Kate McCann on the evening the little girl disappeared.

She said she spotted the man striding from the area of the McCann's apartment but had not realised the relevance of what she saw at the time.

The man drawn by the artist has greasy, straggly hair, wearing a purple or maroon top and beige chinos. He is aged about 35 to 40, 5ft 6in (1.7m) tall, and of slim build.

Crucially, the child, with her legs dangling, is wearing the same pyjamas as Madeleine on the evening of May 3.

To ensure accuracy, where Jane Tanner could not be certain, the artist left details blank.

The release of the images, commissioned by private detectives working for the McCanns, was given the "tacit approval" of Portuguese police, said the McCann's spokesman, Clarence Mitchell.

Mr Mitchell said: "This is another important phase of our investigation into Madeleine's abduction and we hope that this picture will be a very important reminder to anyone who was in the area on that night who may have seen this man.

"We believe that this was Madeleine being carried away by a man from the apartment, so we place great importance on having these pictures produced."

The forensic artist who created the images is not being named but she is a world renowned specialist, Mr Mitchell added.

KATE and Gerry McCann vented their fury yesterday at the "madness" of being unable to talk about their daughter in public.

Their frustration has been made all the worse by a whispering campaign directed against them by the Portuguese police.

The couple have been desperate to help in the campaign to find their missing daughter. But they have been advised that since being made official suspects they could be prosecuted if they speak publicly.

The McCanns have been inundated with offers for their story. These include approaches from at least two documentary makers.

Among those lining up to talk to them is the doyen of American television interviewers, Barbara Walters. She has interviewed every American President since Richard Nixon. Producers have set aside an hour-long slot for the couple – once they are free to talk.

"A family friend said: "It is madness. We are being forced to inhabit a fantasy world in which we can increase the public's awareness of Madeleine's disappearance and urge the public's help through a poster campaign. But her own parents cannot help in this because of the legal status attached to them.

"The lawyers are looking at the Portuguese law, but their advice at the moment is that the McCanns cannot speak because of the fear they will breach strict secrecy rules. It is so frustrating."

Things have been made all the worse in recent days with a string of lurid stories appearing in the Portuguese press. The two doctors have been accused of covering up Madeleine's "accidental death". Detectives believe that Kate killed her with an overdose of sedatives and then, with the help of her husband, disposed of the body.

There has been little evidence to stand up the theory – but leaks from the police have made it clear that no other theories are being entertained.

Yesterday the McCanns' spokesman Clarence Mitchell said their London lawyers, Kingsley Napley, were looking at ways in which the couple could talk in the open for the first time in weeks.

Since Madeleine disappeared, interest in the story has spread across the entire world, with news teams from the US, South Africa, Finland, Iceland and most of Europe flocking to Britain to cover it.

Tomorrow will mark the 150th day of her disappearance. But a source said the couple will not mark it with any special event. Kate and Gerry will be treating it as "just another day without Madeleine".

The father of missing three-year-old Madeleine McCann made a fresh emotional plea for help in tracing his daughter.

Following criticism of aspects of how the case had been handled he also expressed the family's thanks to the police for their efforts.

Appearing before a bank of cameras and a crowd of reporters Gerald McCann stood arm in arm with his wife Kate who was again clutching a pink teddy bear as she was earlier when the family were first seen in public following the disappearance which police are now treating as an abduction.

Dr McCann said: "First of all we would like to thank everyone here in Portugal, the UK and elsewhere for all your support during this extremely difficult time for our family.

"We are pleased that the family liaison officers from Leicestershire are now working closely with the Portuguese police in keeping us informed.

"We have no further information regarding the investigation but appreciate the significant effort everyone is making on our behalf.

"We would again like to appeal for any information, however small, that may lead to the safe return of Madeleine.

"Finally we would like to thank the media for respecting our privacy especially that of Madeleine's little brother and sister."

Detectives in the Algarve earlier said they are hunting a "suspect" after evidence appeared to rule out the possibility that Madeleine had gone missing by herself.

While Portugal's Judicial Police - the equivalent of Britain's CID - refused to give precise details of who they are hunting, they revealed that they believed Madeleine was still alive. Hundreds of tourists, British expats and Portuguese residents joined a search for her.

Gerry and Kate McCann's public composure in the immediate aftermath of their daughter's disappearance masked their private turmoil, a witness said.

Alex Woolfall, a public relations consultant who advised the couple, said they reacted exactly as he would expect after Madeleine vanished.

He said their behaviour convinced him of their innocence.

"They were behaving exactly as I thought someone in that situation would be," he told The Times newspaper.

"They had not slept. They were trying to work out what to do that might help generate images of her. They were desperately keen to publicise her face.

"I was struck at the perception of people who had watched Kate and Gerry: that they were very controlled and perhaps were not responding in a way people thought would be more natural.

"They were not at all controlled. When I was with them, they were between being completely distraught and trying to do what they felt was the right thing."

Mr Woolfall is an expert in crisis PR for communications group Bell Pottinger and was employed by the Mark Warner holiday resort in Praia da Luz in Portugal's Algarve, from where Madeleine vanished on May 3.

He helped the McCanns select photographs of Madeleine to be given to the media and to prepare a short statement appealing for help in finding the missing girl.

Portuguese police named the couple as suspects in Madeleine's disappearance, but the couple have always protested their innocence, and turmoil in the police investigation in the last week has further undermined any possible case against them.

KATE McCann's heart-breaking reaction when she realised her daughter Madeleine was missing can be revealed for the first time today. Rushing into the tapas restaurant where her husband and friends were dining, she screamed: "Madeleine's gone! Madeleine's gone!"

Sources close to the McCanns have ­broken their silence about the crucial sequence of events in an attempt to prove there is no way the couple could have harmed their daughter.

The fresh version of events differs ­significantly from that which the Por­tuguese police have been working on and which added to the cloud of suspicion hanging over the couple. Initially it was thought that Kate McCann began shouting, "They've taken her! They've taken her!" when she discovered that the three-year-old was not in the apartment.

Detectives working on the case were understood to be suspicious about this reaction, because it appeared that the McCanns, at such an early stage, had already discounted the possibility that she had wandered off.

One theory being examined by the Portuguese police was that the McCanns accidentally killed the little girl – possibly with an overdose of sedatives – earlier in the evening and then hatched a plan to pretend she had been abducted.

But now a friend who was dining with the family that night has shed new light on the actual events and has dismissed the possibility that the McCanns killed Madeleine as ludicrous.

The friend, who asked not to be named, said Kate acted with such horror and shock that there is no way she could have been faking.

The friend said Kate and Gerry, both 39, were beside themselves as the horror dawned on them that their little girl was gone. The source also attacked Portu­guese police for the way they had handled the investigation, saying it was unbelievable that they had declared the McCanns suspects before questioning their dining companions fully.

She said: "It is farcical that detectives could even make Kate and Gerry suspects without speaking to witnesses at the time. Throughout all of this the police have never come back and asked eyewitnesses whether the McCanns could be faking it.

"There is no way they can charge them without speaking to the friends. It's a farce. They were so distressed and distraught there is no way anybody could act like that. Even in a movie nobody could fake it like that. Their suffering was completely real." The friend explained that Kate's reaction on discovering her daughter had vanished was one of utter despair.

At 10pm she left the tapas restaurant to check on Madeleine and the two-year-old twins Sean and Amelie.

On realising that her eldest child was missing, she raced the short distance from the apartment back to the restaurant screaming: "Madeleine's gone! Madeleine's gone!"

Her husband Gerry also became very distressed and they were both sobbing and screaming.

The source said: "Eyewitnesses are convinced there is absolutely no way they could have been faking it. It would be absolutely impossible."

The group, who have been dubbed the Tapas Nine, then began a frantic search for the little girl. Shortly afterwards the police were contacted and the search was widened.

The McCanns' fellow diners – Matthew and Rachael Oldfield, David and Fiona Payne and her mother Dianne Webster, and Russell O'Brien and his partner Jane Tanner – were all initially interviewed by detectives. But they were not asked specific details about the McCanns' reaction and behaviour.

Meanwhile, the global campaign to find Madeleine – who would now be four – continues apace with plans for a stunt at Everton's game at the weekend against Aston Villa.

A huge banner is due to be unveiled at Villa Park, in Birmingham. One of the most enduring images of Madeleine is of her wearing an Everton football shirt.

The couple spent six hours yesterday in discussions with Michael Caplan, QC, one of the UK's top criminal solicitors,ÔÇéand the rest of their legal team at their office in central London.

Looking tired and drawn, Gerry, had arrived in a silver people-carrier with his wife at midday and greeted the assembled press pack with a short but courteous "Good morning".

Under review was the significance of Wednesday's statement from the Portu­guese prosecutor that no new evidence had emerged in the fortnight since they were declared "arguidos", or official suspects, to justify calling them for new interviews at present.

The couple's official spokesman Clarence Mitchell, who joined them at the meeting, said: "There is still a long way to go in the legal process. They still remain official suspects. Their lawyers are studying what was said. This is a positive step – a step in the right direction."

Gerry and Kate McCann left their solicitors' office at 6.07pm. Gerry said they would "remain silent" about the discussions. They then drove back to their home in Rothley, Leicestershire.

Madeleine: Police Want Answers to 14 Questions

POLICE chiefs have drawn up a dossier of new questions for Kate and Gerry McCann about the night their daughter disappeared, it was revealed yesterday. Detectives are travelling from the Algarve with an official request to interview Madeleine's parents and the seven friends with whom they were on holiday in Praia da Luz.

They will table 14 key questions in an attempt to break the deadlock in the stalled investigation. The news came on the day Kate broke down and sobbed during a TV appearance in which she and Gerry spoke of their belief that Madeleine is still alive.

Investigators believe that members of the party – dubbed the Tapas Nine after the Spanish-themed restaurant they were in when Madeleine disappeared – may have been involved in the crime.

Gerry and Kate will be interviewed for the second time as official suspects but it will be the first interrogation in Britain. The outcome of the interviews, to be held within days, could lead to Portuguese police naming other members of the group as official suspects.

Under Portuguese law, detectives would have to declare them "arguidos" in order to ask them key questions about events leading up to the night of May 3 when Madeleine vanished.

Three detectives are now set to fly to Britain bearing a legal letter signed by a Portuguese judge, asking their counterparts in the UK to table the series of questions on their behalf.

It is likely the interviews will be conducted by officers from Leicestershire police who have already been helping the investigation.

But Portuguese officers are hoping to be present during the interrogations, which will be the first to take place since the days immediately after Madeleine disappeared from the McCanns' holiday apartment at the Ocean Club resort.

The couple were dining at the restaurant on the complex with seven friends, including Rachael Oldfield, 36, Matthew Oldfield, 37, Jane Tanner, 36, Russell O'Brien, 36, Fiona Payne, 34, David Payne, 41, and Dianne Webster, Fiona Payne's mother.

The interviews will be confined to questions covered in the formal request from the Portuguese judge. Algarve detectives may ask for follow-up questions to be put to the group but it is only at the discretion of British police carrying out the interviews. A source within the Policia Judiciaria said: "The presence of our investigators in the interrogation room is important because they can analyse the gestures and facial expressions of those interviewed. "This is an important part of a criminal investigation.

It is what they call behavioural analysis." The key questions reveal how Portuguese detectives are sticking to the theory that the McCanns, and possibly their friends, are involved in Madeleine's disappearance. Her parents, and the family friends, have strenuously denied any involvement in Madeleine's disappearance and insist she was abducted.

They also deny any wrongdoing. Last night a friend of the McCanns said: "Kate and Gerry's friends are expecting to be interviewed again at some point and are happy to co-operate and do anything they can to help find Madeleine."

One member of the group, Jane Tanner, 36, has already told police how she saw a man carrying a child wrapped in a blanket near the Ocean Club complex on the night Madeleine disappeared.

Miss Tanner told police the man was heading towards the home of Robert Murat – the British expat who was named as the first official suspect.

Murat, 33, was also placed in the frame by three other members of the McCanns' party.

Miss Tanner's hospital consultant partner Dr Russell O'Brien, 36, Dr Fiona Payne, 34, and doctor's wife Rachael Oldfield, 36, all claimed they saw Murat near the McCanns' apartment on the night Madeleine disappeared.

In July the three friends flew back to Portugal to confront Murat over his alibi during a tense five-hour grilling. Murat – now set to be cleared – insisted he did not leave home that night and went to bed early after dining with his mother Jenny, 71.

Dr Payne's medical researcher husband David, 41, is said to have been one of the last people to see Madeleine. He joined Kate and her children at the McCanns' apartment at 6.30pm on May 3 after Gerry asked him to check on them while he was having a tennis lesson.

Members of the party have told police they took it in turns to check on the children during the evening. Police are said to be concerned at inconsistencies in the statements of the McCanns and their friends of the events that took place that night.

Robert Murat hired a car after discovering he was under police surveillance, it was revealed last night.

Police are investigating why Murat, the main suspect in the abduction of Madeleine, hired a baby blue Hyundai Getz from Audio Rent III Car Hire nine days after the four-year-old vanished.

Maria Rocio, who works for the hire company, alerted police after she realised Murat's home had been raided by detectives two days after he rented the car.

She said she was concerned by the suspect's behaviour and the desperation in his voice. Mrs Rocio said she first received a call from Murat at midday on Saturday and recognised him because he has used the service before.

"He said he needed to hire a car for himself because the English people who were looking for the missing girl needed to borrow his car," she said.

"He told me he could not use his car because they had put up posters in it showing the missing child. I thought to myself, 'Why?'"

Mrs Rocio said Murat called again at 3pm and asked if he could pick up the car straight away.

She said: "I did suggest he get it from someone else but he still arrived to pick it up at 5.15pm." The hire form filled in by Murat gave his address as that of his estranged wife Dawn's in Dereham, Norfolk.

He also gave his UK driving licence when he hired the car on an initial three-day contract.

Murat's elderly mother Jennifer returned the car on Tuesday after detectives examined it on Monday.

Mrs Rocio said: "When I saw that police were interviewing him I phoned police and told them about him hiring the car.

They have now been into the office and asked to check the records of everybody who has hired a vehicle between 28 April and 5 May.

"There was something about his voice. He needed to have the car quickly and his voice was very impatient. The reason it was odd is that he already has his own car."

Friends of Murat in the village where he used to live in Norfolk have launched a poster campaign protesting his innocence, urging him to be strong and to think of his daughter.

Portuguese Carla Cunha, who Murat helped to get a job at the Bernard Matthews plant, produced the notices and posted them around Hockering.

Mrs Cunha, 35, said: "He is a lovely person and kind and helps everybody. This must be a big mix-up. I know he has nothing to do with this."
